第1条（本規約について）

本利用規約（以下「本規約」）は、「ひとくち」（以下「本アプリ」）の利用に関する条件を定めるものです。本アプリをダウンロードまたは使用することにより、本規約に同意したものとみなします。

第2条（サービス内容）

本アプリは、日々の水分補給を記録・管理するためのiOSアプリケーションです。以下の機能を提供します:

  1. 飲料の種類と量を記録する機能
  2. 1日の水分補給の進捗を表示する機能
  3. 水分補給のリマインダー通知機能
  4. Apple ヘルスケアアプリへの水分量書き込み機能（オプション）
  5. テーマやボイスパックによるカスタマイズ機能

第3条（アプリ内課金）

  1. 本アプリは基本機能を無料で提供します
  2. 追加機能（プレミアム、テーマ、ボイスパック）は、App Store内のアプリ内課金（買い切り型）により提供されます
  3. すべてのアプリ内課金は非消費型（Non-Consumable）であり、一度購入すると永続的に利用可能です
  4. 課金はAppleの決済システムを通じて処理されます
  5. 返金に関してはAppleの返金ポリシーに従います
  6. すべてのアプリ内課金はFamily Sharingに対応しています

第4条（Apple標準EULA）

本アプリの使用には、Appleの「Licensed Application End User License Agreement」（標準EULA）が適用されます。本規約とApple標準EULAの間に矛盾がある場合、Apple標準EULAが優先されます。

第5条（医療に関する免責事項）

重要: 本アプリは水分補給の記録を補助するアプリであり、医療機器ではありません。医療的なアドバイス、診断、または治療を提供するものではありません。

  1. 本アプリに表示される水分係数は、文部科学省食品成分表に基づく参考値です
  2. 個人の体質・健康状態により、実際の水分吸収量は異なります
  3. 水分摂取量の目標設定や健康上の判断については、かかりつけの医師にご相談ください
  4. 本アプリの使用により生じた健康上の問題について、開発者は一切の責任を負いません

第6条（知的財産権）

  1. 本アプリに関する著作権、商標権、その他の知的財産権は開発者に帰属します
  2. ユーザーは、本規約で許可された範囲内でのみ本アプリを使用できます
  3. 本アプリのリバースエンジニアリング、逆コンパイル、逆アセンブルは禁止します

第7条（禁止事項）

ユーザーは以下の行為を行ってはなりません:

  1. 本アプリを違法な目的で使用すること
  2. 本アプリの正常な動作を妨害すること
  3. 本アプリを改変、複製、配布すること

第8条（免責事項）

  1. 本アプリは「現状有姿」(as is) で提供されます
  2. 開発者は、本アプリの正確性、完全性、信頼性について保証しません
  3. 本アプリの使用または使用不能により生じたいかなる損害についても、開発者は法令で許容される最大限の範囲で責任を負いません
  4. 端末の故障、OSのアップデート等によりデータが失われた場合、開発者は責任を負いません

第9条（サービスの変更・終了）

開発者は、事前の通知なく本アプリの機能を変更、追加、または削除する権利を有します。

第10条（規約の変更）

  1. 開発者は、本規約を随時変更できるものとします
  2. 重要な変更がある場合は、アプリのアップデートを通じてお知らせします
  3. 変更後の規約は、アプリのアップデートをインストールした時点で効力を生じます

第11条（準拠法・管轄）

  1. 本規約は日本法に準拠し、日本法に従い解釈されるものとします
  2. 本アプリに関する紛争については、東京地方裁判所を第一審の専属的合意管轄裁判所とします

Article 1 (About These Terms)

These Terms of Service (hereinafter "Terms") set forth the conditions for using "Hitokuchi" (hereinafter "the App"). By downloading or using the App, you agree to these Terms.

Article 2 (Service Description)

The App is an iOS application designed to record and manage daily hydration. It provides the following features:

  1. Recording the type and amount of beverages consumed
  2. Displaying daily hydration progress
  3. Hydration reminder notifications
  4. Writing water intake data to Apple Health (optional)
  5. Customization through themes and voice packs

Article 3 (In-App Purchases)

  1. The App provides basic features for free
  2. Additional features (Premium, themes, voice packs) are available through one-time in-app purchases on the App Store
  3. All in-app purchases are Non-Consumable and are permanently available once purchased
  4. Payments are processed through Apple's payment system
  5. Refunds are subject to Apple's refund policy
  6. All in-app purchases support Family Sharing

Article 4 (Apple Standard EULA)

Use of the App is subject to Apple's "Licensed Application End User License Agreement" (Standard EULA). In the event of any conflict between these Terms and Apple's Standard EULA, the Apple Standard EULA shall prevail.

Article 5 (Medical Disclaimer)

Important: The App is a hydration tracking tool and is not a medical device. It does not provide medical advice, diagnosis, or treatment.

  1. The hydration coefficients displayed in the App are reference values based on the Standard Tables of Food Composition in Japan (MEXT)
  2. Actual water absorption varies depending on individual physiology and health conditions
  3. Please consult your physician regarding water intake goals and health-related decisions
  4. The developer assumes no responsibility for any health issues arising from the use of the App

Article 6 (Intellectual Property)

  1. All copyrights, trademarks, and other intellectual property rights related to the App belong to the developer
  2. Users may use the App only within the scope permitted by these Terms
  3. Reverse engineering, decompiling, or disassembling the App is prohibited

Article 7 (Prohibited Activities)

Users shall not:

  1. Use the App for illegal purposes
  2. Interfere with the normal operation of the App
  3. Modify, duplicate, or distribute the App

Article 8 (Disclaimer of Warranties)

  1. The App is provided "as is"
  2. The developer makes no warranties regarding the accuracy, completeness, or reliability of the App
  3. The developer shall not be liable for any damages arising from the use or inability to use the App, to the maximum extent permitted by applicable law
  4. The developer assumes no responsibility for data loss due to device failure, OS updates, or similar causes

Article 9 (Service Modifications)

The developer reserves the right to modify, add, or remove features of the App without prior notice.

Article 10 (Changes to Terms)

  1. The developer may modify these Terms at any time
  2. Significant changes will be communicated through app updates
  3. Updated Terms take effect upon installation of the app update

Article 11 (Governing Law and Jurisdiction)

  1. These Terms shall be governed by and construed in accordance with the laws of Japan
  2. Any disputes related to the App shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance
